The super accelerated examination is a system enabling an examination to be conducted more quickly than under the ordinary accelerated examination upon the applicants' request.

Compared to the ordinary accelerated examination, examination results come out more quickly. The average First Action (FA) pendency under the super accelerated examination is less than 1 month in 2020, which is much shorter than under the ordinary accelerated examination.

An application eligible for the super accelerated examination is a patent application for which the examination request has been filed and whose examination process has not begun. Also, such an application must meet both of the following requirements (1) and (2):

• (1) An application which is “working-related” and “internationally filed,” or an application filed by startups which is “working-related” ^{(*1) (*2)} ; and
• (2) An application for which all application procedures are performed online during 4 weeks before the date of the request for the super accelerated examination.

• (*1) Conditions for “working-related” and “internationally filed” are the same as those for the ordinary accelerated examination.
• (*2) For more information on conditions for “filed by startups”, please refer the .

• (1) The flow of requesting for the super accelerated examination is same as that of the ordinary accelerated examination. To request for the super accelerated examination, please file the “written explanation of the needs of the accelerated examination”. In the document, please describe the bibliographic information, needs of the super accelerated examination, disclosure of prior art documents and explanation of the comparison between the claimed invention and prior arts, etc.
• (2) Please be aware that the following A ~ D below are situations where the super accelerated examination will be inapplicable and the application will be handled as an ordinary accelerated examination.
  • A. Where procedures other than the online procedures have been performed after the 4 weeks before the date of the request for the super accelerated examination, including cases where office actions are not received online but sent in writing.
  • B. Where there was a formality deficiency with applicant’s procedures after requesting for the super accelerated examination and a delay has occurred with the examination.
  • C. When a response to an office action has not been made within 2 months by overseas applicants (within 30 days for domestic applicants) from the date of issue of the office action.
  • D. Where, with respect to a divisional application, the applicant has not explained, in a petition or in the “written explanation of the needs of the accelerated examination”, that the said divisional patent application meets the substantive requirements for the divisional patent application, etc.
• (3) Request for the super accelerated examination is free of charge.
